Despite promises, attorneys are scarce as the US resumes speedy asylum screenings at border SAN DIEGO (AP) — As the Biden administration prepared to launch speedy asylum screenings at Border Patrol holding facilities this spring , authorities pledged a key difference from a Trump-era version of the policy: Migrants would be guaranteed access to legal counsel.Nearly three months and thousands of screenings later, the promise of attorney access appears largely unfulfilled, based on advocacy group reports and interviews with people directly involved, some of whom spoke to The Associated Press on condition of anonymity because they were not authorized to discuss the effort publicly. A coterie of involved attorneys estimate that perhaps 100 migrants have secured formal representation, and only hundreds more have received informal advice through one-time phone calls ahead of the expedited screenings.Jones Day, one of the world’s largest law firms, has partnered with the administration to provide free legal advice to migrants. Its phone bank handled 460 informal phone consultatio...

Service charge vs. tip: What's the difference?

Service charge vs. tip: What's the difference? (NEXSTAR) – As restaurants feel pressure to add surcharges to diners' tabs to make ends meet, you may see a few unfamiliar fees on your next bill. It might be labeled a "living wage fee," which helps the restaurant better pay staff that don't traditionally receive tips. Some businesses have added a health care surcharge to help cover the cost of offering employees benefits. Some restaurants added service charges to cover COVID-related costs, such as PPE. More rarely you might encounter something like a carbon offset fee."Any non-discretionary charge added to a restaurant or bar customer's bill, regardless of what it's called, is a service charge," explained Denise Mickelsen, communication director with the Colorado Restaurant Association and Foundation. Food delivery fees add up. Who keeps the money from all those surcharges? While these charges add some percentage extra on top of your bill, these are usually not the same as tips or gratuities. "Because service charges are c...

Stephen L. Carter: For now, we still need this imperfect solution — affirmative action — to a compelling problem.

Stephen L. Carter: For now, we still need this imperfect solution — affirmative action — to a compelling problem. So it’s over. Seriously. It’s hard to find a simple workaround to rescue affirmative action in college admission after last week’s 6-3 Supreme Court ruling that the programs at Harvard and the University of North Carolina violate the 14th Amendment. Oh, given time, we’ll come up with something. But Chief Justice John Roberts’s majority opinion paints so broadly that those of us who hope to find a path around it will have to be exceedingly clever.Let’s start with what the majority got right.First, as Roberts writes, colleges and universities should not be allowed to “establish quotas for members of certain racial groups or put members of those groups on separate admissions tracks” — a quotation drawn from the Court’s 2003 opinion in Grutter v. Bollinger. I agree. Not only are quotas intrinsically bad, but as the court points out, they lead to confusion, such as casually lumping East Asians and South Asians together, and figh...
